Used Car Buying Guide - Californian Lemon Law Explained

By Mike S Walker

Know your rights! Make sure you understand the law if you buy a used car in California. The Californian lemon law covers a vehicle that has an express, written warranty. This is basically the seller or manufacturer's written promise to repair or replace defective parts for a stated period of time.

In theory if you buy a used car in California you are legally entitled to have the defects repaired or a replacement given as long as you have the aforesaid warranty. However you could still be charged for use prior to the defect arising. This charge is not easy to calculate as there is no set formula as there is with new vehicles.

The list below should help you avoid buying a lemon and if you do get stitched up you will have the relevant paper work to support your claim.

* Always run a check on the car on make sure that the dealer is being honest about the history of the car.

* If there is no warranty offered with the vehicle BEWARE. It is probably a ringer.

* You deserve a warranty with a used car. Read the document carefully to make sure it offers decent, fair guarantees.

* Give yourself piece of mind by having an inspection of the car performed by an independent, qualified mechanic.

* Test drive the car for at least 20 minutes as this will help find any potential faults.

* If you feel that the car is dodgy or that the dealer is not being truthful be smart and DO NOT BUY THE CAR.

In the event of a disagreement always seek legal advice.

There is nothing worse than getting home only to find that we have bought a lemon. Buying a used car can be a minefield. You need to do your research and be prepared to haggle hard if you want to get a great car for a great price. To get the upper hand you need to know the what is in the dealer's playbook. - 21396
